Case name - Krautsaum – Abgrenzung Wald
ISSUE - Zwischen Wald und Feld existiert meist ein „Krautsaum bzw. Ödlandstreifen“. Bis zu welcher Breite des „Krautsaum bzw. Ödlandstreifens“ kann dem benachbarten Feldblock noch das EFA-Element „Streifen von beihilfefähigen Hektarflächen an Waldrändern“ zugesprochen werden? REPLY - In accordance with Article 46(2) of Regulation (EU) No 1307/2013, strips along forest edges should be located on eligible hectares in order to qualify as EFA. The arable land should be directly adjacent to the boundary of the forest. Under the assumption that the so called ' Krautsaum' is neither eligible land nor forest, a strip on the eligible land adjacent to this ' Krautsaum' cannot qualify as a strip along a forest edge in the scope of EFA. Please note that there might be alternatives to declare this so-called 'Krautsaum' as an EFA.
