| Case name - Small narrow parcel | |
| ISSUE - The reference parcel is small and narrow with RP area = 285m2. Original delineation is based on orthoimage 2009. The dam was not included in the RP because it was not visible on this orthoimage that this area is part of the RP. On the orthoimage 2013 the fence is visible and it is clear that the dam belongs to the RP. The new delineation holds an area of 300m2. Area deviation is 5,3%. According to 2% update margin update is required. According to ETS treshold (7%) the RP is conform. | REPLY - In accordance with Article 5(3) of Regulation (EU) No 640/2014 the Member State shall ensure that the MEA per reference parcel is correctly quantified within a margin of maximum 2%, thereby taking into account the outline and condition of the reference parcel. As in this case, due to the dam (culvert), the eligibility as well as the outline of the parcel clearly changed, the reference parcel has to be adapted. |
