Case name - Non eligible path small versus large parcel
ISSUE - AAN-parcel 1351893. RP area= 30.345 m2. Original delineation no unpaved road. On orthoimage 2013 clear unpaved road. Also visible in 2011 en 2012. New delineation. New area= 29.470m2. Area difference is 875m2. In percentage 2,88%. If AAN-parcel 1351893 would be joined together with the neighbouring AAN-parcel 1351891 (ditch is damped), this ‘new merged’ AAN-parcel has a registered area of 43.343m2 + 30.345 m2 = 73.688m2. Area difference 875m2, but only 1.18%. No update needed? REPLY - In accordance with Article 5(3) of Regulation (EU) No 640/2014 the Member State shall ensure that the MEA per reference parcel is correctly quantified within a margin of maximum 2%, thereby taking into account the outline and condition of the reference parcel. As in this case, due to the newly created path, the eligibility as well as the outline of the parcel clearly changed, the reference parcel has to be adapted. Also in case the parcel would be merged with the parcel in the north, the path need to be excluded and the reference parcel need to be updated.
