| ISSUE - Liegt ein Landschaftselement innerhalb des „Krautsaum bzw. Ödlandstreifen“ zwischen Ackerfläche und Wald, stellt dieses dann einen Trennungsgrund für das EFA-Element „Streifen von beihilfefähigen Hektarflächen an Waldrändern“ dar oder nicht? | REPLY - In accordance with Article 46(2) of Regulation (EU) No 1307/2013, strips along forest edges should be located on eligible hectares in order to qualify as EFA. The arable land should be directly adjacent to the boundary of the forest. Under the assumption that the so called ' Krautsaum' is neither eligible land nor forest a strip on the eligible land adjacent to this ' Krautsaum' cannot qualify as a strip along a forest edge in the scope of EFA. In this respect, the question whether or not the 'HK' feature is preventing the possibility to create a strip along a forest edge, is not relevant. Please note that there might be alternatives to declare this so-called 'Krautsaum' and/or the ' HK' as an EFA. In such a case the 'HK' prevents the part of the 'Krautsaum' behind from qualifying as an EFA. |
