| ISSUE - Am Rand von Ackerlandfeldblöcken befinden sich häufig Bewirtschafter-Wege die keine öffentlichen Wege sind, sondern nur der Erreichbarkeit der Schläge dienen. Können solche „temporär gefahrene Wege“ als Pufferstreifen an Gewässer außerhalb von LF (Ufervegetation) mit eingerechnet werden? Oder stellen diese zu mindestens keinen Tren-nungsgrund für die Ausweisung eines Pufferstreifens an Gewässer auf Ackerland dar? | REPLY - The road visible on the picture is used to reach field and thus not eligible for BPS. However, in accordance with Article 46 of Regulation (EU) No 1307/2013 a buffer strip may also be adjacent to arable land, meaning that the road itself could be considered as being the buffer strip and thus could qualify as EFA. Please note that from this picture it is not clear whether there is a watercourse to which the possible buffer strip is buffering to. |
