Case name - Line of trees
ISSUE - Document DS/EGDP/2013/16-rev2 art 45 point 4. gives the definition for trees in line: "(c) trees in line with a crown diameter of minimum 4 meters. The space between the crowns shall not exceed 5 meters;". After a storm one of the trees was lost, a new tree replaced the old... but the crown isn't yet 4 meters. So the farmer lost this EFA element. REPLY - This landscape feature may still qualify as EFA as trees in line. Maintenance of landscape features such as the replacement of a fallen tree by a new one is acceptable.In addition, in accordance with the third subparagraph of Article 45(4) of Regulation (EU) No 639/2014 Member States may include trees, recognised by them as valuable landscape features with a crown diameter below 4 meters.
